The right to privacy includes the right to know when and why personal data is collected, the use and sharing of personal information, the ability to access and correct one’s own data, and protection from surveillance. While there are various suggestions regarding why privacy is important and how it can be safeguarded, these suggestions reach the structural limits of law, functioning as a superstructure. In this study, which explains the right to privacy based on Evgeny Pashukanis’s theory of legal form, the right to privacy is defined as a social form arising directly from market logic, focusing on what law is (its form) rather than on the content of law (what it says). The right to privacy is not a liberal ideal or merely an ideological deception; it is a structural necessity for the capitalist system to function. This right serves as a structural gateway through which capital acquires access to private life. The right to privacy forms the legal subject as the mirror image of the commodity owner. Privacy is not merely an individual preference or right; it is a legal mechanism that constructs the “private” sphere where contracts are formed and labor power is exploited in secret from the public eye. Through digital enclosure in data-meta production, law becomes a functional and “specific” tool that capitalism requires for the datafication of everyday life and the human inner world. This analysis brings with it demands that aim to overturn the logic of the existing system and push against its structural limits. Privacy can only be protected if the right is defined collectively rather than individually, if commodification is rejected, and if the digital rights struggle is addressed by focusing on base and production relations.
