Günümüzde toplumsal hayatın ayrılmaz parçasını oluşturan spor kulüpleri, spor faaliyetlerinin yanı sıra büyük ekonomiye sahip olmaları bir yana yine aynı büyüklükte borçlanma sebebiyle mali sorunlar ile karşı karşıya kalabilmektedir. 26.04.2022 tarihinde Resmi Gazete’de yayımlanan 7405 Sayılı Spor Kulüpleri ve Spor Federasyonları Kanunu’nda, kulüplerin mali açıdan bu tarz sorun ve suistimallere karşı korunması amacıyla bir takım düzenlemeler yapılmıştır. Bunlardan bir tanesi de spor kulübü alacaklarının devrine ilişkin düzenlenen yeni hükümdür. Söz konusu hükmün, emredici hüküm niteliğinde olması ve spor kulüplerinin korunması amacına hizmet etmesi sebebiyle incelenmesi önem arz etmektedir. Çalışmanın kapsamını da oluşturan konu üç başlık altında incelenmiş olup; birinci bölümde spor kulübü kavramı ve spor kulüplerinin gelirleri, ikinci bölümde alacağın devri kavramı, niteliği, şartları ve spor kulübü alacaklarının devri, üçüncü bölümde ise spor kulübü alacaklarının devrine ilişkin özel hüküm niteliğinde olan kanunun 20/4 maddesi incelenecek olup söz konusu hükme aykırı devirler bakımından devrin akıbeti ve borçlunun hak ve yükümlülükleri açıklanacaktır.
Although sports clubs, which are an integral part of social life today, have a large economy in addition to sports activities, they may face financial problems due to the same amount of borrowing. In the Law No. 7405 on Sports Clubs and Sports Federations published in the Official (Legal) Gazette on 26.04.2022, some arrangements were made in order to protect the clubs against such problems and abuses financially. One of them is the new provision regarding the assignment of sports club receivables. It is important to examine the said provision as it is a mandatory provision and serves the purpose of protecting sports clubs. This subject, which also constitutes the scope of the study, has been examined under three headings; In the first part, the concept of sports club and the incomes of sports clubs, in the second part the concept of the assignment of receivables, its nature, conditions and the assignment of the receivables of the sports club, in the third part, article 20/4 of the law, which is a special provision regarding the assignment of the receivables of the sports club, will be examined. The outcome of the assignment and the debtor’s rights and obligations will be explained.
