Although the emergence of intellectual products dates back to the beginning of similar desires of human beings, which can be described as self-actualization, such as the desire to express oneself, to bring solutions, to express one's problems or to produce, when we look at the literature, it is seen that the historical process of the protection of intellectual and industrial property rights dates back to the 1400s. When the creation of relevant legislation on the subject in the historical process is considered as a beginning; regulations related to legislation and various events affecting daily life on a global scale affect the practical process of protection. This study is about "Furniture" and "Industrial Property Rights" on the axis of breaking points. A literature review on the subject was conducted and document analysis was preferred as a method in accordance with the purpose and scope of the subject. Within the scope of the study, a literature review of the perspective on the historical process of intellectual and industrial propoerty rights on a global scale and in our country is included. With reference to the review, industrial property rights were analyzed to identify significant amendments to national legislation and influential events on a global scale. The protection of designs with special provisions in 1995 and the entry into force of the Law number 6769 on Industrial Property with a radical amendment in 2017 are milestones. COVID-19 pandemic was considered as an important cause that had a global impact in 2019. The design registration applications and design registration data of the Turkish Patent and Trademark Office, which is a local authority that carries out the registration procedures of industrial property rights, between 1995 and 2023 for "Furniture" are analyzed and the data are interpreted in relation to the historical process.
Fikri ürünlerin ortaya çıkması; insanın kendini ifade etme, çözüm getirme, derdini anlatma ya da üretme isteği gibi kendini gerçekleştirme olarak nitelendirebileceğimiz benzer isteklerinin başlangıcına kadar dayanıyor olsa da literatüre bakıldığında fikri ve sınai hakların korunmasının tarihsel sürecinin 1400’lü yıllara dayandığı görülmektedir. Tarihsel süreçte konuya dair ilgili mevzuatların oluşturulması bir başlangıç olarak ele alındığında; mevzuatlarla ilgili düzenlemeler ve küresel ölçekte gündelik yaşamı etkileyen çeşitli olaylar korumanın pratik sürecini etkilemektedir. Yapılan bu çalışma kırılma noktaları ekseninde ‘‘Mobilya’’ ve ‘‘Sınai Haklar’’ ile ilgilidir. Konuya ilişkin literatür taraması yapılmış ve konunun amaç ve kapsamına uygun olarak doküman analizi yöntem olarak tercih edilmiştir. Çalışma kapsamında küresel ölçekte ve ülkemizdeki fikri ve sınai hakların tarihsel sürecine ilişkin perspektifin literatür taramasına yer verilmiştir. Taramadan referansla sınai haklar özeline inilerek ulusal mevzuatta yapılan önemli değişiklikler ve küresel ölçekteki etkin olaylar tespit edilmiştir. Tasarımların özel hükümlerle 1995 yılında korunmaya başlanması ve 2017 yılında köklü bir değişiklikle 6769 sayılı Sınai Mülkiyet Kanunu’nun yürürlüğe girmesi dönüm noktalarıdır. COVID-19 ise 2019 yılında küresel ölçekte etkili olan önemli bir olay olarak ele alınmıştır. Sınai hakların tescil işlemlerini yürüten yerel bir otorite olan Türk Patent ve Marka Kurumu’nun ‘‘Mobilya’’ özelinde 1995-2023 yılı arasındaki tescil başvuruları ve tasarım tescili verileri incelenmiş ve tarihsel süreçle ilişkilendirilerek veriler yorumlanmıştır.
