In this study, David Hume’s approach to justice, law, and the right to private property, which is directly related to the aforementioned notions, will be examined within the scope of his legal and political philosophy. The study will evaluate how this ap- proach laid the foundations of a positivist understanding of law and how it influenced the legal theories of Jeremy Bentham and John Austin, the founding figures of legal positivism. During a period when capitalism had become the dominant mode of production, Hume’s remarks, based on the separation of natural law and posi- tive law, provided a framework to meet the needs of the economic, political, social, and legal realities of England. Following the path opened by Hume, Bentham and Austin placed this distinction at the centre of their legal theories and developed a legal approach that was compatible with the political economy order of England at the time.
Bu çalışmada, David Hume’un hukuk ve siyaset felsefesi kapsamında adalet, hukuk ve bunlarla doğrudan bağlantılı olan özel mülkiyet hakkına ilişkin yaklaşımı incelenecektir. Söz konusu yakla- şımın, pozitivist bir hukuk anlayışının temellerini nasıl oluşturduğu ve hukuki pozitivizmin kurucu isimleri olan Jeremy Bentham ile John Austin’in hukuk teorilerini nasıl etkilediği değerlendirilecektir. Kapi- talizmin hâkim üretim biçimi haline geldiği bir dönemde, Hume’un doğal hukuk ile pozitif hukukun ayrılığına dayanan görüşleri, İngiltere’nin iktisadi, siyasal, toplumsal ve hukuki gerçekliklerinin ge- reksinimlerini karşılamaya dönük bir çerçeve sunmuştur. Bentham ve Austin de Hume’un açtığı bu yolda ilerleyerek, ilgili ayrımı hukuk teorilerinin merkezine almış ve dönemin İngiltere’sinin ekonomi po- litik düzeniyle uyumlu bir hukuki yaklaşım geliştirmiştir.
